Terms & Conditions.

These Terms & Conditions cover the services I provide as Charlie Johns Personal Training (CJPT). They apply to all clients — 1:1 sessions, group training, structured PT plans, and online coaching.

By signing up to any service, you confirm that you've read and accepted these terms. If anything in here doesn't make sense or you'd like clarification, email me at charlie@cjpt.ie before signing up. I'd rather you ask now than be surprised later.

Who I am.

I trade as Charlie Johns Personal Training (CJPT), and I'm based at Phenom Gym, Monahan Road, Ballintemple, Cork. My contact details are at the bottom of this page.

I'm an independent personal trainer. I rent floor space at Phenom Gym but I'm not employed by Phenom and Phenom is not party to any agreement between us.

I'm not VAT registered, so no VAT is charged on any service. If that changes in future I'll update these terms and notify existing clients.

Before we start: health and liability.

Before your first session or before starting any plan, you must complete the health and training questionnaire I send you. This is a standard PAR-Q (Physical Activity Readiness Questionnaire) plus a few extra questions about your goals and history.

The information you give me must be accurate and complete. If anything changes during our work together (new injury, new medication, new diagnosis, pregnancy, anything relevant), tell me as soon as it happens.

I am a qualified personal trainer, not a doctor, physiotherapist, or dietitian. If your questionnaire indicates you should consult a doctor before starting exercise, I'll ask you to do that first and provide medical clearance. If I think you need a physiotherapist or other specialist at any point, I'll say so.

I hold public liability and professional indemnity insurance appropriate to my work.

You acknowledge that:

  • Physical exercise carries inherent risks, including but not limited to muscle strains, joint injuries, falls, and (very rarely) more serious cardiovascular events.
  • You're participating voluntarily and accept these risks.
  • You will inform me immediately of any pain, discomfort, or symptom during a session, and I will adjust or stop the session as appropriate.
  • You're responsible for following the form cues and instructions I give you in person and via written programming.

To the maximum extent permitted by Irish law, I'm not liable for injuries that result from you withholding relevant health information, ignoring my coaching cues, training outside our sessions in ways I haven't programmed, or pre-existing conditions you knew about but didn't disclose.

Payment.

All services are paid for upfront, via Stripe. I don't accept cash or bank transfer for new clients.

For services with a recurring weekly cost option (e.g. PT Plans paid weekly), the first payment is taken before week one and subsequent payments are taken automatically on the same day each week for the duration of the plan.

If a Stripe payment fails (e.g. card expired), I'll pause coaching until it's resolved. Two failed attempts in a row may end the agreement.

Prices are in Euros and inclusive of all taxes (currently zero VAT). Prices listed on the website at the time of your booking are the prices that apply to you for the duration of that plan, even if I change them later.

Cancellation, rescheduling, and refunds.

Single 1:1 sessions and 10-packs

  • Outside 24 hours' notice: reschedule freely, just message me as early as you can.
  • First last-minute cancellation (inside 24 hours): no charge. Reschedule and we'll find another slot.
  • Any subsequent last-minute cancellation: uses up a session from your 10-pack, or forfeits the cost of a single session.

Unused sessions in a 10-pack expire 3 months after purchase. Extensions are case-by-case for genuine medical or life events.

Group training sessions

Group bookings are higher-stakes because I block the time and may turn down other work.

  • More than 24 hours' notice: reschedule once for no charge. A second reschedule incurs a 25% charge on the total group booking.
  • Less than 24 hours' notice: 50% charge on the total group booking.

The person who booked the session is liable for any cost. How the group splits it is up to them.

Structured PT Plans (in-person, upfront-paid)

If you want to stop a plan partway through and you paid upfront, you'll receive a refund equal to 50% of the value of the remaining unused portion of the plan.

Example

You paid €299 upfront for a 12-week plan and want to stop after week 4. There are 8 weeks remaining (two-thirds of the plan, worth approximately €199). You'd receive 50% of that — €99.50 — refunded to the original Stripe payment method within 10 working days.

This split exists because I've already done planning, programming, and administrative work for the full plan, and because the upfront commitment is part of what makes the plan effective in the first place. The 50% structure is a fair middle ground between "no refund" (which I think is harsh) and "full pro-rata" (which doesn't reflect the front-loaded work).

If you paid weekly, you can stop at any time with one week's notice. You're charged for that final week and then payments end.

Online Coaching — first-week money-back guarantee

Online clients have an unconditional first-week money-back guarantee. If, after your first weekly check-in call, you decide online coaching isn't for you, tell me on the call and I'll refund what you paid in full to the original Stripe payment method within 7 working days.

The guarantee only applies before the second check-in call. Once we've moved past week one, the standard plan refund policy (50% of the remaining unused portion) applies.

Custom one-off programmes (€60)

Once a custom programme has been written and delivered, no refunds. If you want changes within the first two weeks, I'll make reasonable revisions for free.

My obligations to you.

I commit to:

  • Showing up on time to every session, ready to coach.
  • Writing your programming before the plan starts and updating it every four weeks.
  • Responding to messages within 24 hours during working days (Mon-Fri, 6 AM - 3 PM Irish time). Weekend messages will be answered Monday.
  • Telling you honestly when I think you should consult a specialist (doctor, physio, dietitian) rather than rely on me.
  • Maintaining the qualifications and insurance my work requires.

If I cancel a session at short notice for a reason that isn't a genuine emergency, I'll either reschedule with priority or refund the equivalent value.

Your obligations to me.

To get the most out of our work, you commit to:

  • Showing up to scheduled sessions on time (or rescheduling within the cancellation policy below).
  • Completing the health questionnaire honestly and updating me when health-relevant things change.
  • Doing the programmed training between sessions as best you can. I understand life happens — but if you stop showing up to your own training entirely, coaching becomes very hard to do well.
  • Paying on time.
  • Treating me, Phenom staff, and other gym users with basic respect. I reserve the right to end the agreement immediately and without refund for serious or repeated rudeness, harassment, or behaviour that endangers others.

Photos, videos, and testimonials.

I'd love to share client wins on Instagram and the website, but only with your explicit permission.

  • I will never post a photo, video, or testimonial that identifies you (face, name, recognisable detail) without first asking you and getting clear written consent (a "yes" via WhatsApp, email, or Slack counts).
  • Progress photos you send me as part of training are for our use only. I will never share them anywhere without separate, specific permission.
  • You can withdraw permission for any past content at any time by emailing me, and I'll remove it from CJPT-controlled channels within 14 days. Third-party reposts or screenshots I don't control are beyond my reach.

Online coaching specifics.

Online clients agree to:

  • Attend a 15-minute weekly check-in call over Zoom at the agreed time. Missed calls without notice can be rescheduled at my discretion — but consistent no-shows make coaching impossible and may end the agreement.
  • Be honest in weekly check-ins. The work only works if I have an accurate picture of what's actually happening.
  • Train with a setup we've agreed on. If your equipment situation changes (you change gyms, lose access to a home gym), tell me so I can adjust the programming.

Form-check video reviews are turned around within 48 hours of you sending them on Slack.

Intellectual property.

The training programmes, diet guides, and content I create for you are for your personal use only. You're welcome to keep using them indefinitely after our work ends. But please don't share them publicly, sell them, or pass them off as your own.

The website content (cjpt.ie copy, photos, layout) is mine and protected by copyright. Don't republish it elsewhere.

Ending the agreement.

You can stop working with me at any time. Refunds follow the policy in section 5.

I can also end the agreement at any time. If I end it for a reason that isn't your fault (e.g. I close the business, I'm unable to keep coaching for health reasons), you receive a full pro-rata refund of any unused portion. If I end it because of a breach by you (e.g. non-payment, abusive behaviour), no refund is due.

Disputes and governing law.

If anything goes wrong, talk to me first. I'd rather sort it out directly than escalate.

If we can't resolve it: these terms are governed by Irish law and any dispute falls under the exclusive jurisdiction of the courts of Ireland.

You also have the right to use the EU's Online Dispute Resolution platform as a consumer.

Changes to these terms.

I may update these terms occasionally. If you're an existing client and the update materially affects you, I'll email you the changes and the date they take effect — usually 14 days from notification. Continuing to use the service after that date is taken as acceptance.

Minor changes (typo fixes, clarifications) won't trigger a notification.
